Show Me The Money! Legal Strategies for Construction Contractors to Protect the Right to Payment

Payment may be slow coming ven when the contractor’s work has been completed and accepted. In those instances, the contractor needs to protect its entitlement to payment by recording a Claim of Lien against the project. Unbeknownst to many contractors, the right to record a Claim of Lien against the project can be lost during the course of the work if lien waivers are being executed and submitted with each pay application. Further, lien rights do not run forever, and oftentimes, contractors lose their lien rights by waiting too long to record their Claim of Lien. All of this also applies to payment bond claims on public projects. During this session, we will walk through Georgia’s lien and bond law, with an emphasis on how to avoid losing your lien rights or losing your payment bond claim. And we will also touch on the legal implications of bid bonds for those contractors bidding work directly to a public owner. 

The class portion will run for 75 minutes and then lunch and networking (available for IN-PERSON ONLY) will be the remaining 45 minutes.
